台灣戰爭史回顧 (281)

台灣聽證(Congressional Hearing on Taiwan)。The Government of the United States should review and hear of the following historical and legal aspects on Taiwan: 美國政府應檢討並聽取以下歷史和法律方面對台灣:
1. Pursuant to Articles 2(b) and 2(c) of Treaty of Shimonoseki signed on April 17, 1895 and entered into force on May 8, 1895, China cedes to Japan in perpetuity and full sovereignty the island of Formosa, together with all islands appertaining or belonging to the said island of Formosa, and the Pescadores Group. 1、根據1895年4月17日簽訂馬關條約第2條(b)和2(C),在1895年5月8日條約生效,中國割讓給日本永久和完全的主權,台灣島嶼連同所有島嶼附屬物,或屬於上述島嶼的台灣,澎湖列島。
2. Pursuant to the Cairo Communique released on December 1, 1943, Formosa and the Pescadores shall be restored to the Republic of China. It should be noted that by the time the Cairo Communique was released, Formosa and the Pescadores were still unincorporated territories of Japan. 2、根據1943年12月1日發布的開羅公報,台灣及澎湖群島歸還給中國(中華民國)。應當指出:當時開羅公報發表後,台灣及澎湖列島仍然是未合併(未編入)日本領土。
3. Japan fully applied the Meiji Constitution to Formosa and the Pescadores on April 1, 1945. As a result, the Law of Nations is applicable to Formosa and the Pescadores which have been incorporated as integral parts of Japan ever since. 3、1945年4月1日,日本充分運用明治憲法,實施於台灣及澎湖列島。因此,台灣及澎湖列島適用該法的國家領土條件,已註冊成為日本領土不可分割的部分至今。
4. Japan formally surrendered to the Allied Powers on September 2, 1945. 4、1945年9月2日,日本正式向盟軍投降。
5. By the Law of Nations, nations can not alter natural obligations by agreement, nor individually or mutually release themselves from it. 
5、按照萬國公法規定,國家無法改變自然的義務,儘管是通過協議,也不能單獨或合議解放其應負的義務。
6. Pursuant to Article 2(b) of the San Francisco Peace Treaty signed on September 8, 1951 and entered into force on April 28, 1952, Japan renounces all right, title and claim to Formosa and the Pescadores founded on Japanese "rights of nation" or "rights of sovereignty" over Formosa and the Pescadores. 6、根據1951年9月8日簽署舊金山和平條約第2條(b),進入1952年4月28日生效,日本政府放棄所有台灣及澎湖列島權利,名器與請求(管轄權),這是建立在日本天皇事實擁有對台灣及澎湖列島的「國家權利」或「主權權利」。
Pursuant to Article 23 (a) of the Peace Treaty with Japan, the United States of America is the principal occupying power of Japan including Taiwan. As a result, Japan retains "obligations
of nation" or "obligations of sovereignty" as the residual sovereignty over Taiwan, whereas the United States, due to the "fact of conquest", holds "rights of occupation" de jure as well as "obligations of occupation" de jure over Taiwan after the San Francisco Peace Treaty entered into force. 根據與日本的和平條約第23條(a),美利堅合眾國是日本、包括台灣的主要佔領權國。因此,日本仍保留台灣領土的「義務的國家或義務的主權」等剩餘主權。而美國由於「征服的事實」,法理上,舊金山和平條約生效後,美國被認為擁有「法理佔領權」以及「法理佔領義務」。
7. Pursuant to the Constitution of the United States Article 6, all treaties made, under the authority of the United States, shall be the supreme Law of the land. 7、根據美國憲法第6條規定,在美國憲法下所簽之所有條約,該領土應是擁有最高法律地位。
8. Pursuant to the Constitution of the United States Article 1 Section 8, the Congress shall have power to define and punish offences against the Law of Nations. 8、根據美國憲法第1條第8款,國會有權決定和懲罰任何違犯萬國公法行政。
9. Pursuant to the Constitution of the United States Article 2 Section 1, the President shall inaugurate with an oath or affirmation that he will to the best of his ability, preserve, protect and defend the Constitution of the United States. 9、根據美國憲法第2條第1項規定,美國總統就職典禮時應宣誓,自己將盡力以最佳能力,維持、保護和捍衛美國憲法。
10. Pursuant to the Constitution of the United States Article 2 Section 3, the President shall take care that the laws be faithfully executed.
10、根據美國憲法第2條第3款規定,美國總統應注意使法律切實執行。

Dear Friends, 
We have exciting news. 
For several years the Formosa Foundation has been discussing with senior staff members for U.S. Rep. Ileana Ros-Lehtinen (R-FL), on the possibility of a hearing on the issue of Taiwan. I am thrilled to report that the Congresswoman, who is now the Chair of the House Foreign Affairs Committee, has confirmed that she is open to the idea of holding a full committee hearing in 2011 on "Why Taiwan Matters." 
This is a tremendous opportunity to demonstrate for the American political establishment the importance of a robust and open relationship with Taiwan. The Formosa Foundation looks forward to working with other longtime supporters on this project. While timing and other details of the hearing have yet to be determined, please feel free to forward any ideas and suggestions so that we may share them with the Congresswoman. 
The Formosa Foundation is profoundly grateful that Congresswoman Ros-Lehtinen has shown innovation and fearless leadership in her new position as committee chair, and applauds her for fighting for democracy and human rights across the globe.
