台灣戰爭史回顧 (153)

有關「台灣民政府」的重要觀念釐清。在舊金山和平條約之架構下,日本依 Article 2b 放棄「台灣領土權(非台灣主權)」,而美國則基於「征服日本」之事實,有權執行對「日本台灣領土」之暫時佔領,而依 Article 23a 有權利取得日本所放棄之台灣「領土權(管轄權)」。台灣國際地位要能正常化之關鍵,就是在於美國將於何時 (when)? 及如何 (how)?終結中國殖民政權之代理佔領,並設立「台灣民政府」,將台灣「領土權」移轉予本土台灣人 (people of Taiwan),而非「台灣關係法」所稱之(people on Taiwan)以施行自治 (self-government),而非自決 (self-determination),這是非常重要的戰爭法觀念。

美國以日本征服國之身份,依戰爭法有責任(duty) ,在台灣佔領地設立「民政府」,其本質為一種戰爭行為而非關民意,美國軍事政府對於「台灣民政府」之 設立涉及「戰爭法」,受「法理」約束;而美國軍事政府對於「台灣民政府」之 移轉同時也涉及「承認」,有「政治」考量。在目前階段,本土台灣人所應提醒美國的是「法理設立」,而不是「政治承認」台灣民政府。 

台灣人一旦覺醒,所要面臨的,將可能是會被冠上「叛國或外患」罪名。因此,如要期待本土台灣人覺醒,在可見的未來是困難的,控訴美國之主要目的之一,就是要提醒美國在二戰後,對台灣領土有尚未了結之戰爭責任,而無關乎本土台灣人之能否覺醒。縱然只有少數本土台灣人理解控訴美國之真實意義,台灣即已「覺醒」,星星之火足以燎原。在國際戰爭法之架構下,現在只問「法理」,而暫時無涉屬於政治範疇之「民意」。

而至於「台灣民政府」後續演變,或許才會有「民意」之空間。

"The foreign relations of the United States are conducted by the President of the United States, and the Executive and Legislative Branches will decide whether and under what circumstances the United States will recognize a sovereign government over Taiwan." 
中國殖民政權代理美國執行台灣佔領之「現狀」,即是美國已依 SFPT Article 23a啟動行使台灣領土權之「證明」。然而,美國尚虧欠本土台灣人一個能讓台灣國際地位正常化之「台灣民政府」,而至於「台灣民政府」後續演變,或許才會有「民意」之表達空間。 

By the year of 2012, on the one hand, the new U.S. Compound located in Neihu, Taipei shall have been in operation; on the other hand, the Government of Japan will formally decline to deem the people of Taiwan as Chinese.

The reconciliation to be made within 3 years through 3 conventions on 3 forums between the Chinese on the east side of the Taiwan Strait ("people on Taiwan" under TRA) and the Chinese on the west side of the Taiwan Strait ("people on the China mainland" under TRA) symbolizing the conclusion of the Chinese civil war and the termination of the Chinese exiled government in Taipei (Chinese Taipei) should be favorable to the normalization of the status of Taiwan. The saying that Taiwan will be annexed by China in three years is, therefore, manifestly absurd. The governing authority on Taiwan essentially being the Chinese colonial authority performing the agent of the USMG so as to enjoy de facto territorial rights of Taiwan is not entitled to make any agreement with China at the risk of violating the agency law, hence not to mention a fabricated "peaceful unification".

The relationship between the people of the United States and the people on Taiwan under the Taiwan Relations Act is, as a matter of fact, "official", but "informal" i.e., "political" under the "principal-agent frame".

The relationship between the people of the United States and the people of Taiwan under the U.S.-China Joint Communique is, however, "unofficial", but "formal", i.e., "legal" under the "laws of war".
